Terms of Service

These Terms of Service ("Terms") govern your access to and use of BM Quotes ("the Service"), provided by BM Quotes ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

The Service

BM Quotes is job-management and quoting software for trade businesses, including quoting, scheduling, a field app, job costing, invoicing and integrations with third-party services such as Xero. We may add, change or remove features over time.

Accounts

You must provide accurate information when you register and keep your login credentials secure. You're responsible for activity that happens under your account and for the people you invite to your workspace. You must be authorised to act for the business you register.

Free trial

New accounts may start with a 14-day free trial. A valid payment method is required to begin. Unless you cancel before the trial ends, your subscription begins automatically and your payment method is charged at the applicable rate.

Subscriptions & billing

• Pricing is based on the number of users in your workspace, as set out on our pricing page. Prices are in AUD and exclude GST unless stated.
• Adding users may change your plan and price. You'll be shown the change before it applies.
• Subscriptions renew automatically each billing period until cancelled.
• You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.
• Payments are processed by Stripe, subject to their terms.

Your data

You retain ownership of the data you enter into the Service. You grant us the limited rights needed to host, process and display that data to provide the Service and the integrations you enable. Our handling of personal information is described in our Privacy Policy.

Acceptable use

You agree not to misuse the Service, including by attempting to disrupt it, access it without authorisation, reverse-engineer it, or use it to break the law or infringe others' rights.

Third-party services

The Service connects with third parties such as Xero and Stripe. Your use of those services is governed by their own terms, and we're not responsible for them.

Availability

We work to keep the Service available and reliable, but we don't guarantee it will be uninterrupted or error-free. We may perform maintenance or make changes that temporarily affect availability.

Intellectual property

The Service, including its software, design and branding, is owned by us and protected by law. These Terms don't grant you any rights in it other than the right to use it as intended.

Liability

Nothing in these Terms excludes rights you have under the Australian Consumer Law that can't lawfully be excluded. Subject to that, to the extent permitted by law, the Service is provided "as is", and our liability to you is limited to resupplying the Service or the amount you paid us in the previous 12 months.

Termination

You can stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or fail to pay. On termination, your right to use the Service ends; we'll make your data available for a reasonable period so you can export it, after which it may be deleted.

Changes to these Terms

We may update these Terms from time to time. We'll post the current version here with the "last updated" date above; continued use after changes means you accept them.

Governing law

These Terms are governed by the laws of Australia, and you submit to the courts of the relevant Australian jurisdiction.
